    1. Acceptance of Terms

    By accessing or using The Pep Report website and services (the "Services"), you agree to be bound by these Terms of Service. If you do not agree, do not use our Services. These Terms form a legal agreement between you and DigitalTreehouse LLC ("we," "our," "us").

    2. Description of Services

    The Pep Report provides a DNA-informed personalized peptide and nutraceutical platform, plus access to licensed telehealth providers for prescribing and pharmacy fulfillment of peptides, nutraceuticals, and related treatments. Our Services include:

    • The Pep Test™ DNA collection kit and personalized report
    • Access to telehealth visits with independently licensed healthcare providers, currently facilitated through our partner FUSE Health Inc. ("Telehealth Partner")
    • Prescription and fulfillment of approved treatments through the Telehealth Partner's affiliated pharmacy network
    • Optional monthly subscription for ongoing research updates, alerts, and Pep Club benefits

    We reserve the right to change, add, or replace our telehealth, prescribing, or pharmacy partners at any time, without notice, at our sole discretion. Your care relationship is with the independently licensed provider who treats you, not with The Pep Report or DigitalTreehouse LLC directly.

    3. Not Medical Advice

    Our Services are for educational and informational purposes only. The Pep Report is NOT a medical diagnosis, medical advice, or a substitute for professional medical consultation. We do not diagnose, treat, cure, or prevent any disease.

    All peptide protocols require a prescription from a licensed healthcare provider. You should always consult with a qualified healthcare provider before starting any peptide, supplement, or nutraceutical regimen, especially if you have existing medical conditions, are pregnant or nursing, or are taking medications.

    Telehealth visits facilitated through our Services are provided by independently licensed healthcare providers who make their own clinical judgments. The Pep Report and DigitalTreehouse LLC do not practice medicine, do not employ or control these providers' medical decisions, and are not a party to the provider-patient relationship.

    This statement has not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.

    4. Telehealth Services

    If you choose to use telehealth services offered through our platform:

    • You will be connected with a licensed healthcare provider appropriate to your state of residence.
    • Telehealth visits are subject to additional informed consent, which you will be asked to review and accept separately before any visit.
    • Not all treatments are available in all states. Prescribing decisions, including whether to prescribe, are made solely by the treating provider.
    • Some treatments involve compounded medications, which are not FDA-approved in the same manner as manufactured drugs. Your provider will discuss any relevant risks with you.
    • Controlled substances (where applicable) are subject to additional state and federal requirements and may not be available in every state.
    • We reserve the right to change telehealth or pharmacy partners at any time. Your existing prescriptions and care history will be handled in accordance with applicable law during any such transition.

    Informed consent for the telehealth visit itself is obtained and documented by your treating provider at the time of care, as required by applicable state law. This Terms of Service and our separate Telehealth Informed Consent describe your relationship with The Pep Report; they do not replace the clinical consent your provider will ask you to complete.

    5. Controlled Substances

    Some treatments may involve controlled substances. Federal rules currently permit providers to prescribe certain controlled substances via telehealth without a prior in-person visit; this flexibility is temporary, presently authorized only through December 31, 2026, and may change or end at any time. If federal or state rules change, some treatments may require an in-person evaluation before they can be prescribed or continued.

    6. Compounded Medications

    Some treatments may involve compounded medications prepared by a licensed pharmacy for you individually. Compounded medications are not FDA-approved and have not undergone FDA premarket review for safety, effectiveness, or quality in the way manufactured drugs have. Your provider will discuss the specific medication being prescribed.

    7. Eligibility

    You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

    8. Account Registration

    To access certain features, you must create an account. You agree to:

    • Provide accurate and complete information
    • Maintain the security of your password
    • Notify us immediately of any unauthorized account access
    • Accept responsibility for all activity under your account

    9. The Pep Test™ Orders

    When you order The Pep Test™:

    • Payment is due at checkout
    • Kits ship within 2 business days
    • You must collect the sample according to the instructions provided
    • You must return the sample using the pre-paid envelope
    • Reports are typically delivered within 3 weeks of sample receipt at our laboratory partner
    • All sales are final once the kit has been shipped

    We reserve the right to refuse or cancel orders at our discretion.

    10. The Pep Club membership (monthly subscription)

    The Pep Club membership is $9.99 per month. Membership is optional and is not required to purchase The Pep Test™. Members who joined at a previous price keep that price until they cancel.

    • Your card will be charged monthly starting 30 days after your initial report is delivered
    • The membership auto-renews until canceled
    • You can cancel anytime through your account settings
    • Cancellation takes effect at the end of the current billing period
    • We do not issue refunds for partial months
    • We reserve the right to change membership pricing with 30 days' notice, and a price change does not affect members who joined at an earlier price unless they cancel and rejoin

    Research use of de-identified genetic and health information is optional and separate from membership. You may decline research participation and remain a member, and you may withdraw research consent at any time from your account settings.

    11. Referral and affiliate program

    Anyone may apply to become an affiliate. Approved affiliates receive a personal referral link, a promotional code, and a QR code. Customers who order through an affiliate link receive a discount on The Pep Test.

    Affiliates earn a commission of ten percent on the price of The Pep Test only. Pep Club membership fees, telehealth orders, and any other purchase are excluded from commission. Commission is earned when an order is completed and is calculated on the kit portion of the order.

    Payouts are made through Stripe Connect. Affiliates must complete Stripe's onboarding, including identity verification, before any payout can be made. Stripe's terms apply to the payout account, and we do not hold or control those funds.

    Affiliates see only aggregate information about their referrals: the number of visits, the number of orders, and the commission owed. Affiliates never receive customer names, contact information, order details, quiz answers, or reports.

    Healthcare providers approved through our provider program receive a referral link and promotional code so their patients receive a discount, but they participate at a zero percent commission rate and are never paid.

    We may withhold commission, reverse a payout, or end an affiliate's participation for fraudulent orders, self-referral, spam, misleading claims about our product, or any conduct that violates these Terms. We may change commission rates or program rules with notice to active affiliates.

    12. Genetic Data Ownership and Use

    You retain ownership of your genetic information. By using our Services, you grant us a license to:

    • Process your DNA sample and generate your report
    • Store your genetic data securely
    • Use de-identified data to improve our knowledge base and services
    • Update your recommendations as new research becomes available

    You can request deletion of your genetic data at any time by contacting privacy@thepep.report.

    If you use telehealth services, your health and intake information (separate from your genetic data) may be shared with your treating provider and their affiliated pharmacy solely to provide your care. This information is governed by our Privacy Policy and, where applicable, by our Telehealth Partner's own privacy and HIPAA practices.

    13. Intellectual Property

    All content on our website, including text, graphics, logos, reports, software, and recommendations, is the property of DigitalTreehouse LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.

    "The Pep Report," "The Pep Test," and associated logos are trademarks of DigitalTreehouse LLC.

    14. User Conduct

    You agree NOT to:

    • Use our Services for any illegal purpose
    • Submit someone else's DNA sample without their written consent
    • Attempt to reverse engineer, decompile, or hack our systems
    • Scrape or systematically extract data from our website
    • Submit false or misleading information
    • Interfere with other users' access to our Services
    • Use our Services to develop competing products

    15. Disclaimers

    OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

    GENETIC SCIENCE IS CONSTANTLY EVOLVING. WHILE WE USE THE BEST AVAILABLE RESEARCH, WE CANNOT GUARANTEE THAT ALL RECOMMENDATIONS WILL BE ACCURATE OR EFFECTIVE FOR EVERY INDIVIDUAL. INDIVIDUAL RESPONSES TO PEPTIDES AND NUTRACEUTICALS VARY.

    WE ARE NOT RESPONSIBLE FOR HEALTH OUTCOMES RESULTING FROM YOUR USE OF PEPTIDES, SUPPLEMENTS, OR ANY RECOMMENDATIONS IN YOUR REPORT.

    16. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF OUR SERVICES IS LIMITED TO THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

    WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR HEALTH OUTCOMES.

    17. Indemnification

    You agree to indemnify and hold harmless DigitalTreehouse LLC, its officers, employees, and partners from any claims, damages, losses, or expenses arising from your use of our Services, your violation of these Terms, or your violation of any third-party rights.

    18. Termination

    We may suspend or terminate your account at any time for violation of these Terms or any reason at our discretion. You may terminate your account anytime by contacting us. Termination does not entitle you to a refund for fulfilled services.

    19. Governing Law and Disputes

    These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration in Williamson County, Tennessee, except that either party may seek injunctive relief in court for intellectual property violations.

    20. Changes to Terms

    We may modify these Terms at any time. We will notify you of material changes by email or through a notice on our website. Your continued use of our Services after changes become effective constitutes acceptance of the updated Terms.
